In the contemporary world, the right to privacy stands as one of the fundamental human rights, playing a pivotal role in upholding the freedom and security of every individual. The GDPR, Privacy in Electronic Communications Regulations (PECRs) and Data Protection Act 2018 (or DPA) is the laws on privacy in the United Kingdom that makes a Privacy Policy mandatory. Recognizing the significance of this right, dashcamUK holds in high regard and respects the principles of privacy and personal data protection.

We do not collect unnecessary information about you, since we do not need to know more about you than is necessary for our application to work and to maintain convenient communication with you. We do not monetise with Advertising either, so we don't need any personal information to target you. 

We save the collected information no more than is necessary, taking into account the requirements of the law.

We do not share or sell personal information to third parties.

The privacy policy is an integral part of the dashcamUK mobile application user agreement.

Terminology used in this Privacy Policy (hereinafter - the Policy):

DashcamUK application / application is a mobile application created with the purpose of monitoring traffic violations, reducing the number of road fatalities and ensuring prompt response in case of road accidents.

Owner of the Application / dashcamUK - Limited Liability Company "DESHKEMUA", registered in accordance with the requirements of Ukrainian legislation (legal entity identification code: 44338175, location: 03150, Ukraine, Kyiv, 124/128 Antonovycha st; e-mail: dashcamUcontact@gmail.com) is the controller (owner) of personal data for the purposes of the dashcamUK mobile application.

Controller - a person or legal entity, organization or government body that independently or jointly with others determines the purposes and means of processing personal data. An analogue of the term "controller" in the understanding of the laws of England and Wales "On the Protection of Personal Data" is the term "owner".

Statements "we", "us", "our", "ours" found in the text of this Policy, should be considered made on behalf of the Owner of the Application / controller to the users of the application.

User - any individual who has installed the dashcamUK Application and agreed to the registration process, the Terms of Use of the application and this Privacy Policy.

The appeal "you", "yours" found in the text of the Policy should be considered an appeal to the Users of the Application.

Violator - a person who violated the Traffic Rules. Within the terminology of this Privacy Policy and for ease of understanding, we call the Violator a person who hypothetically violated Traffic Rules and a video recording with evidence of such a violation was taken by the User of the application and transferred to dashcamUK.

Personal data - any information about an individual who is identified or can be identified, that is, any information we have about the Users, installed the Application, and information about the Violators that is transmitted to us by the users of the application.

Processing of personal data - any processes and actions with personal data, from its collection, use and storage, transfer for its intended purpose, ending with its disposal.

GDPR - Regulation of the European Parliament and of the Council (EU) 2016 of April 27, 2016 on the protection of individuals in connection with the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (General Data Protection Regulation).

Other terms are used with meanings in accordance with the User Agreement.

Who processes your personal data

The controller of your personal data, for managing and safeguarding your personal data, in accordance with the legal provisions pertaining to the protection of personal information, is the Limited Liability Company "DESHKEMUA".

Where your personal data is transferred

To process and store your personal data, we use Google cloud services, namely the servers of the Google Cloud Platform (Google Firebase), located in the United States.

Since the Controller is located on the territory of Ukraine, some of your personal data may be transferred to Ukraine (if you are located outside Ukraine).

If we receive a reasonable request from State Authorities (court), which is mandatory in accordance with the law, your personal data may be transferred to such State Authorities.

Where personal data of violators are transferred

The personal data of the violators, recorded on the video of the violation of the Traffic Rules, are transferred to the authorized local unit of the UK National Police.

Who has access to your personal data

The Controller and its employees have access to personal data solely for the purpose of fulfilling their job duties and obligations.

All persons who have access to personal data that are processed to fulfill the purposes of the Application have signed the nondisclosure document  to keep  your personal data secure.

Thus, we ensure the confidentiality of the personal data received through the Application.

How we collect personal data

Some of the information that we process about you is provided to us directly by you, when you install and register in the Application.

Some of the information about you is obtained from the application while it is running. For example, information about the geolocation obtained using the phone's GPS module but only when you tap the screen of your mobile phone in order to record a video evidence of a traffic rule violation. In this case information may include both information about you and information about other persons - road users or violators of the Traffic Rules. 

A video recording of a specific traffic incident is stored on the device and transmitted to us only if User decides to report the violation and use video evidence as a proof of it. It is solely the decision of the user to submit a report to the police.

In case if a User opts for functionality of the Crash Detection the information about the detected crash will be transmitted automatically. When opting for Crash Detection, the user provides his consent and authorizes dashcamUK to immediately transfer emergency data information to the Rescue Services and (if picked by User) to the contact list of relatives and friends to be informed about the car crash. Information which will be automatically transmitted immediately after collision is detected includes: GPS coordinates of the collision, video from the main camera of the user’s mobile phone on which dashcamUK application is running, video from selfie camera of the user’s mobile phone. Both video files contain only 5 sec before the collision and 5 sec after the collision. Both videos help to see all peripheral details of the crash and see how many people were in the car during the collision. 

With the development of our application and the launch of new services that you want to use, we may need your other personal data. In this case, we will make the corresponding changes to this Privacy Policy.

1. We use it to provide services to our Users using the application, as well as to communicate with them.

2. We use them to review Users’ reports, make a decision (if needed) and provide Users with real time status of the report. If necessary, we can take measures to verify the accuracy of the information contained in the Users report. Also, if it is necessary to insure the authenticity of the report, we can contact third parties for additional information.

Processing time:

We can process the personal data necessary to provide users with services using the application as long as you use the application.

When the User, using the Application, has recorded a violation of the Traffic Rules and has sent us a video evidence, we process the following data about the User and the Violator:

- the relevant unit of the National Police for the transmission of information about the accident.

Date and time of video recording / date and time of violation of Traffic Rules

It is necessary for the correct display of the circumstances of the event, recorded on video and determining the procedural terms.

Recording the voice of the user and / or other persons, which was recorded on the video recording of the violation of the Traffic Rules (if these persons said something during the time of video recording of the violation)

Ensuring the ownership and admissibility of evidence of violation of the Traffic Rules and ensuring control of the integrity of the video from unlawful changes (fakes, editing, changing parts of the image, etc.)

Video evidences of violation of the Traffic Rules, as well as:

-license plate number of Violator's car;

- type of violation;

- depending on the type of violation and the surroundings, there might be some information about the Violator and of some other people (for example: the image of the face, the voice).

2) Ensuring the ownership and admissibility of the video - as evidence of violation of  the Traffic Rules;


3) Preparation and submission of violation reports to the police.

1) Processing is necessary to protect the legitimate interests of Users and the controller of personal data, which are to ensure law and order and road safety (according to the laws of England and Wales "On the Protection of Personal Data" / paragraph f of the first article 6 of the GDPR).


2) The benefits of processing such personal data, both for users and for society, far outweigh the intrusions into the privacy of Violators, which may result from such processing.

 

Information about the location of the vehicle recorded (Violator) at the time of violation of  the Traffic Rules.

To understand the exact location of the violation in order to determine:

- what type of the Traffic Rules apply in this zone (for example, the zone of action of the restrictive sign, etc.);

- the relevant unit of the National Police for the transmission of information about the accident.

Processing is necessary to protect the legitimate interests of Users and the controller of personal data, which are to ensure law and order and road safety (according to the laws of England and Wales "On the Protection of Personal Data" / paragraph f of the first article 6 of the GDPR).

 

How we process and where we pass information about traffic violations

The video evidence of the violation of the Traffic Rules, made with the help of the Application, is sent to us by the User together with information about the license plate of the vehicle of the Violator and the Type of Violation.

As the first step, the data reaches the server of the Google Cloud Platform system (Google Firebase), and then reviewed by employees of the Controller. After checking that the evidence is fully represented in the video, an official Report is then generated to the police. Report contains  all details about the incident (timestamp, exact GPS location) and online access to review the video evidence. 

The application does not have the functionality to download third-party videos (for example videos taken with a car's dashboard camera). This is done in order to ensure the integrity of the video (prevention of fraud, editing, changing parts of the image, etc.), as evidence of a violation of the Traffic Rules.

We use user's phone number for:

We do not share any videos we receive from Users with third parties. We send videos only to the police, or upon request from the court. Some videos with examples of brutal violations of the Traffic Rules could be used for demo video in dascamUa social channels

Processing time:

Information about the violation of the Traffic Rules, including video recordings and personal data of the Violators and witnesses of the violation, is kept by us during the period of investigation of the administrative or criminal case, as well as during the period of appeal.

User’s rights in connection with the processing of personal data

Due to the fact that we process your personal data in accordance with the legislation on personal data protection, you have the following rights:

Right of access to your personal information - you have the right to request from us a copy of your personal information that we process.

The violator, in the understanding of this Privacy Policy, has the right to access his personal information only upon judicial request. This procedure is established only for the purpose of ensuring the confidentiality / protection of personal data, given that otherwise we cannot reliably identify the person of the Infringer.

Right to correct your data - you have the right to ask us to correct personal information that you consider inaccurate.

If you believe that your data is incomplete - you also have the right to ask us to supplement your data, providing us with the missing. However, if, for the purposes of our processing of personal data, we do not need such additional information - we may deny you this request.

You can also change information such as phone number or e-mail.

Right to delete your personal data (right to be forgotten) - you have the right to delete your personal information.

We delete information about you if you:

Right to limit the processing of personal data - you have the right to ask us to limit the processing of your personal information if you are concerned about its accuracy or how it is used.

Please note that restrictions on the processing of some of your personal data may make it impossible to use the application or its individual functions, in accordance with our Terms of Use.

Also, you can ask not to delete your personal data and keep it for you for a while, if necessary.

Right to object to the processing of personal data - you have the right to object to our processing of your personal information in order to offer you our services in the future and determine their relevance.

Making changes to the Privacy Policy

We may make changes to the Privacy Policy, but we do not intend to limit your rights described in this Policy in connection with these changes. In this case, we will mark the date of the last changes made to the Policy and provide access to its previous version. If significant changes are made, we will announce them in addition by posting information about it on our website and / or on PlayMarket and AppStore

By processing your personal data, we implement the world's best standards for data security and privacy. We adhere to all requirements and principles of personal data protection established by the current legislation of Ukraine and the General Regulation on Personal Data Protection of the European Union (GDPR).

In addition, we want to assure you that we make every effort to ensure that all information that becomes known to us about you in the course of our interaction remains confidential.
